Public Channels and Scope
Foodex public forms, general email channels, and other open communication methods are intended for initial business inquiries, applications, expressions of interest, and other non-confidential communications.
Unless Foodex has expressly agreed otherwise, these channels should not be treated as secure or confidential communication channels.
This notice applies across Foodex Ecosystem public channels and may be supplemented by more specific instructions for a particular service, Node, market, or activity.
Information You Should Not Submit
Do not submit information through a public Foodex channel if disclosure could create significant commercial, legal, security, privacy, or confidentiality risks.
For an initial inquiry, provide only the level of information reasonably necessary for Foodex to understand the opportunity, question, or request.
- Trade secrets, confidential formulas, recipes, processes, methods, or proprietary technical information.
- Unannounced commercial plans, strategies, transactions, product launches, pricing structures, or other highly sensitive business information.
- Confidential customer, supplier, employee, partner, or stakeholder information.
- Passwords, access credentials, payment card information, banking credentials, or security codes.
- Government identifiers, highly sensitive personal information, or regulated data that is not necessary for the initial inquiry.
- Information that you are legally or contractually required to keep confidential.
Public Submissions Are Not an NDA
Submitting an inquiry, application, proposal, document, or Foodex Node Expression of Interest does not by itself create a confidentiality agreement or non-disclosure agreement between you and Foodex.
It also does not create a partnership, agency, appointment, exclusivity arrangement, fiduciary relationship, representation right, or commitment by Foodex to proceed with a proposed engagement.
Personal information included in a submission will be handled in accordance with the applicable Foodex Privacy Notice, but privacy obligations should not be confused with a separate contractual duty to protect confidential business information.
Your Responsibilities
You are responsible for ensuring that any information, documents, or materials you submit to Foodex are accurate to the best of your knowledge and that you have the right and authority to provide them.
If you are unsure whether information is appropriate to share through a public channel, contact Foodex first and describe the type of information without disclosing the sensitive details.
- Do not submit information that belongs to another person or organization unless you are authorized to provide it.
- Do not submit material that infringes intellectual property, privacy, confidentiality, contractual, or other legal rights.
- Do not deliberately submit false, misleading, unlawful, harmful, or fraudulent information.
- Limit public submissions to the information reasonably necessary for Foodex to understand and evaluate the relevant inquiry or opportunity.
How Foodex Handles Submissions
Foodex may review, organize, route, and evaluate information submitted through its public channels for the purpose relevant to the submission, such as responding to an inquiry, evaluating a potential engagement, or assessing a Foodex Node opportunity.
Where appropriate, a submission may be shared with the relevant Foodex service, team, or authorized Node that needs the information to review or respond to the matter.
Access should be limited to what is reasonably necessary for the relevant purpose and subject to applicable privacy, confidentiality, contractual, security, and data-protection requirements.
Foodex is not required to accept, retain, return, develop, use, compensate for, or proceed with any proposal, idea, application, or other submission unless a separate agreement provides otherwise.
When Confidentiality Is Needed
If a discussion progresses to a stage where confidential or commercially sensitive information is genuinely necessary, Foodex and the relevant party may establish an appropriate confidentiality framework before that information is shared.
Depending on the situation, this may include a non-disclosure agreement, specific confidentiality terms in a broader agreement, restricted access, or another protected communication process.
The appropriate approach will depend on the nature of the engagement, the information involved, the parties, and any applicable legal or regulatory requirements.
Until such a framework is formally established, you should assume that public Foodex forms and general communication channels are not appropriate for confidential business information.
